The following Terms and Conditions define the general terms and conditions of sale applicable to our online store available at www.ibb.pl, operated by

The share capital is: PLN 2,000,000.
The company is entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the capital city of Warsaw. Warsaw, under KRS number 0000857599.

1. Scope of the Regulations
These Regulations apply to all orders placed by Consumers and Entrepreneurs through our online store. Pursuant to Article 22 of the Civil Code, a consumer is a natural person concluding a legal transaction with an entrepreneur that is not directly related to their business or professional activity. Pursuant to Article 43 of the Civil Code, an entrepreneur is a natural person, legal person, or organizational unit without legal personality, to which the law grants legal capacity, conducting business or professional activity in its own name. Other or supplementary Regulations and General Terms and Conditions used by Entrepreneurs do not apply – they will only become part of the contract if we provide express written consent.

2. Conclusion of the contract
The sales contract is concluded with IBB.PL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ. The presentation of products in our online store constitutes an invitation to enter into a contract within the meaning of Article 71 of the Civil Code. To make an offer to purchase products, you must place an order. Using the mechanisms available in our store, you can add selected products to your shopping cart and submit a purchase offer. The shopping cart and the data entered in the forms can be modified before placing the order using the available functionalities and messages displayed during the ordering process. By clicking the button confirming and finalizing the order on the order summary page, you place an order for the products in your cart. After placing your order, you will receive an automatically generated email confirming that your order has been registered. This email does not constitute acceptance of your offer or the conclusion of a sales contract. The sales contract is concluded after verification of the order's suitability for processing and acceptance of your offer, which occurs via a separate email confirming that the order has been approved for processing. Upon receipt of this confirmation, the sales contract is concluded.

3. Language and Rules for Recording the Contract
The sales contract can be concluded in Polish or English.
We record the content of the contract and send you order details and our Terms and Conditions by email. You can also check information regarding your orders through your customer account. The Terms and Conditions are also available on our online store's website, allowing you to retrieve, reproduce, and record their content.

4. Product Delivery - Online Store www.ibb.pl | E-commerce Retail
Ordered products are delivered via our partner courier companies. Shipping within Poland is subject to a fee. Prices may vary depending on the size and quantity of the products ordered. Detailed information can be found during the ordering process and in the dedicated information tab on our store's website. Generally, personal collection of products is possible at: IBB.PL, Ożarowska 40/42, 05-850 Ożarów Mazowiecki, from 8:00 a.m. to 4:00 p.m.

4.1 Product Delivery - Selecting the Courier Delivery Purchase Option
Shipping is subject to an additional fee. Delivery costs depend on the selected delivery method, the weight and dimensions of the package or pallet, as well as the distance between the delivery location and the selected IBB.PL warehouse (delivery costs may vary depending on the delivery location indicated by the Customer). Delivery costs are displayed on the Online Store website during the ordering process (multi-basket), including before placing the order. Information on product dimensions is provided during ordering.

Ordered Products (detail shopping) are delivered only within Poland.
Products are delivered to the Customer.

  • Order processing times are 3, 7, or 14 business days. Regardless of the above, if the ordered product requires specific specifications or requires a long delivery time, it will be moved to the mini-order cart.
  • IBB will inform the customer by phone and/or via SMS and/or email (sent to the phone number/email address provided by the customer) about the next stages of order processing.
  • Shipments delivered by courier weighing up to 30 kg will be delivered to the address provided. Other shipments will be delivered only to the building indicated in the delivery address. Shipments are delivered Monday through Friday.

4.2 Product Delivery - Selecting the Personal Pickup Option (Click & Collect)
If the Customer has selected the personal pickup option as a delivery method, the ordered Products must be collected at the address specified by the Customer on the Online Store website during the ordering process. The address, opening days, and hours of operation of the selected IBB warehouse, as well as the contact telephone number for the selected warehouse, will be provided in the message displayed on the Online Store website after placing the order and in the email confirming receipt of the order.

  • IBB will prepare the order for collection when the goods are in stock for immediate collection. The goods are displayed at the collection point.
  • IBB will inform the Customer by phone and/or via SMS and/or email (sent to the phone number/email address provided by the Customer) when the purchased Products are ready for delivery at the selected warehouse. The
  • Product may be collected in person by the Customer who placed the order, after providing the order number to be collected, or by another person designated by the Customer, upon presentation of the order confirmation (in print or electronic form, e.g., on a mobile device).
  • IBB is entitled to request that the person collecting the Products present an ID document and that the person collecting the Products sign the Product receipt personally. IBB may refuse to release the Products if the information referred to in paragraphs above is not provided, or if the Customer fails to present an ID document or refuses to sign the Product receipt.
  • The Customer must collect the ordered Products within 7 days of receiving notification that the Products are ready for collection. If the Customer fails to collect the Products within this timeframe, the Customer's order will be canceled, and the amount paid for the order will be refunded to the Customer's bank account from which the payment was made. The Customer will be notified via email of the order cancellation.

4.3 Product Delivery - Selecting the IBB Transport Purchase Option
We organize the transport of products purchased on our website. We will deliver the goods to the specified address within the selected time slot. After adding the products to the multi-shopping cart, the customer selects the delivery option (IBB Transport) and confirms the available time slot.

  • Ordered products are delivered exclusively within Poland.
  • The transport of ordered products will be completed within the selected time slot.
  • The cost of transporting the goods depends on the distance between your location and the main warehouse. You can select a convenient delivery time slot and specify the time slot.
    The driver is obligated to assist with unloading; unloading is only possible at the delivery address, and curbside pickup is not available.
  • Products may be moved no further than 25 meters. Products must not weigh more than 30 kg and must not exceed a distance of 25 meters. Products must not be larger than one person.
  • The driver will inform the customer about the delivery on the day of delivery. The driver is required to wait at the delivery location for a maximum of 30 minutes within the selected slot. If the customer does not arrive for unloading, the driver has the right to depart. A repeat delivery will be subject to an additional charge.
  • If a situation beyond our control occurs along the route (e.g., an accident that prevents continued travel, a breakdown that immobilizes the vehicle, etc.) and the driver is unable to continue their journey, we will immediately inform the customer and explain the reasons. We will also present a contingency plan to dispatch another shipment as quickly as possible. The next delivery will be free of charge and at our expense.
  • If the driver arrives at the customer's location and access to the property is not possible due to, for example, overgrown driveways, narrow streets, sidewalks leading to stairwells, etc., the driver will inform the customer that they are unable to drive closer due to difficulties encountered on the approach, and the customer will be asked to collect the goods from the vehicle themselves from the closest accessible location.

5. Product Delivery - Container Module www.ibb.pl | Bulk Sales | Full Loads
All our deliveries are made in accordance with Incoterms.

For deliveries of full containers and trailers, we most often use DDP (Delivered Duty Point) terms.

The customer is responsible for organizing import customs clearance in the UK or using the services of a customs broker.

The seller is not responsible for any problems, delays, damage, or inability to unload the container or trailer resulting from: entry bans, parking bans, inconvenient location of the unloading location, or inadequate security of the unloading location by the Buyer or third parties.

It is the Buyer's responsibility to verify and confirm that delivery of the container or trailer is possible at the location indicated by the Buyer and to ensure that the location is adequately secured for the duration of unloading. The Buyer is also obligated to provide the necessary equipment, including a forklift, and a sufficient number of people to unload the ordered goods.

Any additional costs resulting from the Buyer's failure to fulfill the above obligations are the sole responsibility of the Buyer.
The Seller reserves the right to refuse or suspend delivery if unloading is impossible due to reasons attributable to the Buyer.

5.1 Order Fulfillment and Preparation
After receiving and confirming payment for an order for a full container or trailer, we assemble, carefully prepare, and secure the products for transport to prevent damage during transit.

Full logistics coordination includes a loading schedule and the selection of the appropriate means of transport for the type of load.

5.2 Order Completion Time
The order completion time depends on the products ordered and is displayed on the product card during ordering. The attribute displayed to the customer (3, 7, or 14 business days) indicates the number of days IBB needs to complete the product. Regardless of the above options, it may also happen that the ordered product requires specific specifications or requires a long delivery time, in which case it will be moved to the mini-order basket. 5.3 Product Delivery - Selecting the Full Load Delivery Purchase Option

Delivery costs depend on the selected transport unit size from those available in the container module, as well as the distance between the country and delivery location and the selected IBB.PL warehouse (delivery costs may vary depending on the delivery location indicated by the Customer). Delivery costs are provided on the Online Store website during the ordering process (multi-basket), including before placing the order. Information on product dimensions and the size of the ordered products is provided when placing the order.

  • Ordered Products (refers to ibb.pl - container | full load module) are delivered within the European Union, Ireland, and the United Kingdom.
  • Products are delivered to the Customer via certified freight forwarding companies.
  • Order processing time is 5-14 business days for land transport and 15-25 business days for sea transport.
    Regardless of the above options, it may also happen that the ordered product requires specific specifications or requires a long delivery time.
    In such cases, the delivery time is determined individually and consulted with the recipient.
  • IBB will inform the Customer by phone and/or email (sent to the phone number/email address provided by the Customer) about the next stages of order fulfillment.
  • Full truckload deliveries are delivered to the building specified in the delivery address. The cost of the transport service does not include unloading and/or bringing in the goods.

5.4 Returns and Complaints Related to Customs Procedures
In the event of goods being detained at the border or customs issues, please contact us immediately. Returns and complaints regarding customs procedures will be considered individually, taking into account the principles of cooperation and the obligations of the parties.

5.5 Delays, Damage, Loss of Goods

  • The Seller is not liable for delays, damage, or loss of shipments resulting from causes beyond its control, such as force majeure, including natural disasters, acts of terrorism, acts of war, and civil unrest.
  • The Seller is released from liability if the damage is caused by the actions of third parties or contractors selected by the Customer, provided that due care is taken. due diligence in selecting these entities.
  • The Seller is exempt from liability for the consequences of errors, omissions, or delays by customs authorities, border controls, or other government institutions.
  • The Seller is not liable for any inconvenience or costs associated with the need to conduct customs clearance, if these may be caused by a lack of required documentation or information from the client.

5.6 Additional Information
Shipping full containers and trailers usually requires prior confirmation of the transport date and planning of export and logistics formalities.

Due to the nature of construction goods, additional quality or compliance certificates may apply (upon customer request).

6. Payments
The following payment methods are available in our online store:

  • Electronic payments (e-payments) via an online payment service.
  • Payment by traditional bank transfer to our store's bank account (applies to purchases via the ibb.pl container | full loads module ) - If you choose this payment method, we will email you the transfer details after placing your order. Order processing will begin once the full payment for the order has been credited to our account.

Detailed information about possible payment methods, including online payment services integrated with our store and available e-payment types, as well as any additional costs, is presented during the ordering process and on our store website in a dedicated information tab regarding payment methods.

7. Right of Withdrawal

According to the information contained in the instruction on the right of withdrawal, you have a statutory right to withdraw from the contract.

8. Damage Occurring During Transport
Applies to Consumers: In the case of consumer distance purchases, our store always bears the risk of accidental damage or loss of goods during transport. If the ordered products are delivered with obvious damage incurred during transport, we kindly ask you to report this defect to the carrier and contact us as soon as possible. Delay in filing such a complaint or contacting us will not affect your statutory rights (described below in the section on complaints) or their satisfaction. However, a faster notification will help us pursue our claims against the carrier or transport insurer.

9. Complaints: Conformity of the Goods with the Contract / Defects
Applies to Consumers: We are obligated to deliver goods free of defects. In the event of non-conformity of the goods with the contract, the Consumer has the rights specified in Chapter 5a of the Consumer Rights Act. Under the terms specified therein, the Consumer may request the repair or replacement of the non-conforming goods, submit a declaration of a price reduction, or withdraw from the contract. We are liable for any non-conformity of the goods with the contract discovered within two years of delivery, unless we have specified a longer expiration date for the goods in question, in which case this longer period applies. In the event of non-conformity of the goods with the contract, the above provisions regarding Consumers also apply to individuals entering into a contract directly related to their business activity, if the content of the contract indicates that the contract is not of a professional nature for that individual, in particular arising from the subject of their business activity, as disclosed under the provisions of the Central Registration and Information on Business.

Applies to Entrepreneurs: (with the exception of individuals entering into a contract directly related to their business activity, when the content of the contract indicates that it is not of a professional nature for them – so-called "quasi-consumers," i.e. sole proprietors exercising certain consumer rights): in the case of a sales contract concluded with an Entrepreneur, pursuant to Article 558 § 1 of the Civil Code, our online store's liability under the warranty for defects is excluded.

10. Services Provided Electronically
To use our online store, including browsing our products and placing orders, you must have a multimedia device with an installed web browser and access to the internet and email. It is recommended that JavaScript and Cookies be enabled in your browser settings. Users are required to use the store.

In order to operate the online store in a manner consistent with the law and good practice, it is prohibited to provide illegal content. We take all necessary measures to ensure the proper functioning of the website and our online store interface to the extent possible based on current technical knowledge and undertake to remedy any irregularities and technical problems reported by users within a reasonable time. This also applies to the ability to subscribe to the newsletter or the optional ability to create a customer account – if these services are provided within our store. You can notify us of any detected irregularities or interruptions in the operation of the website and services of our online store using the contact details provided in the section above. In complaints regarding irregularities related to the technical operation of the online store, please indicate the type and date of the irregularity.

12. Out-of-court dispute resolution
We hereby inform you that consumers have the right to use out-of-court complaint and redress procedures. Information on how to access the aforementioned dispute resolution procedures and procedures can be found at the following address: www.uokik.gov.pl, under the "Amicable Resolution of Consumer Disputes" tab. Using the aforementioned out-of-court methods of redress and dispute resolution is voluntary and may only occur if both parties to the dispute (Consumer and Seller) consent.

13. Final Provisions
No provision of these Terms and Conditions is intended to infringe upon the statutory rights of Consumers. In the event of any conflict between the provisions of these Terms and Conditions and the rights of Consumers arising from generally applicable laws, statutory regulations will always apply in lieu of the disputed provisions of these Terms and Conditions.

For Entrepreneurs, Polish law applies to all contracts concluded with us, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For Entrepreneurs, legal entities under public law, or separate public-law entities, the court with exclusive jurisdiction for resolving all disputes arising from the contractual relationship between us and you will be the court with jurisdiction over our registered office. The previous sentence does not apply to natural persons concluding a contract directly related to their business activity, when the content of this contract indicates that it is not of a professional nature for these persons, resulting in particular from the subject of their business activity, made available on the basis of the provisions on the Central Registration and Information on Business.
